BEFORE THE USE OF ANY FOTOR SIGNATURE SERVICE, YOU ARE REQUIRED TO READ, UNDERSTAND AND AGREE TO THESE TERMS. YOU MAY ONLY CREATE AN ACCOUNT AFTER HAVING READ AND ACCEPTED THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THE CONDITIONS SET FORTH IN THIS DOCUMENT, PLEASE REFRAIN FROM USING OUR SERVICE.
1. Fotor Account Terms govern the contractual relationship between you and Chengdu Everimaging Science & Technology Co., Ltd. (“Company”). Company operates Fotor signature services including Fotor, GoArt, Clipfly, PxBee and Facewow. Company reserves the right to modify or discontinue, temporarily or permanently, these terms in whole or in part with or without notice at any time. User agrees that Company shall not be liable to them or to any third party for any modification, suspension or discontinuance of account service. Please also read our Privacy Policy which details how Company securely handles your personal information. Company reserves the right to change these terms, so check back to view them periodically.
2. Fotor signature services are subject to their own terms of service. You agree to be bound by these separate terms when you access or use the signature services. Please read the terms of service that apply to each of our signature services as listed below:

3. Before you can use certain features offered in Fotor signature services, you will need a Fotor Account. We provide a single sign-on (SSO) functionality, which allows you to use your login credentials across Fotor signature services.
4. In order to register for a Fotor Account, you will need to provide information which include a valid email address and a password. You can also register with your Facebook profile or Google Account.
5. As per local laws and regulations, you may be required to provide further information, including personal data, to perform certain service that is obliged to identify you. Please refer to our Privacy Policy for more details.
6. You shall take all necessary steps to ensure that your password is kept confidential. You are required to notify Fotor ([email protected]) without any undue delay if there are signs of misuse of your Fotor Account by any third party.
7. You are not authorized to grant the use of your Fotor Account opened in your name to any third party. Particularly, you are not allowed to 1) share your Fotor Account with others, or 2) lending your Fotor Account to others, or 3) selling the right to use your Fotor Account (hereinafter, collectively referred to as "Unauthorized Access"). You understand that in the case of Unauthorized Access, Fotor shall be entitled to revoke all licenses previously granted to you and to recover from you all loss, damages, costs and charges.
8. Unauthorized Access may also result in infringement on intellectual property rights of a third party other than Company. In the event of such third-party claims against you, Company cannot verify from system record through the account information therefore will not provide you with any authorization certificate or any other form of assistance to hold you harmless. In this case, you shall assume all liabilities on your own.
9. Company has the right to block your Fotor Account temporarily or permanently if there are reasons for Company to believe that you violate these terms, any third-party rights or any applicable law(s). In the event of permanent blocking or deletion, you are not entitled to open up a new Fotor Account or to use any other existing account and Company shall not refund any fees to you.
10. You can delete your Fotor account following instructions in the Help Center (help.fotor.com).
11. Particularly, please be noted that deletion of Fotor Account will result in deletion of data/Content associated with this account. Meanwhile, deletion of Fotor Account does NOT: 1) exempt you from any fees owed to Company; 2) exempt you from other liability or obligation associated with your Fotor Account.
12. These Terms are governed by and construed in accordance with the laws of the People’s Republic of China, without giving effect to any conflict of law principles.
13. You and the legal entity you represent agree, claim or controversy arising out of or relating to these terms or the breach, termination, enforcement, interpretation or validity thereof or the use of Fotor signature services (collectively, “Disputes”) shall be settled by lawsuits.
14. You and the legal entity you represent agree that Disputes between you and Company will be resolved by binding, individual lawsuit and you waive your right to participate in a class action lawsuit.
15. Unless you and Company both otherwise agree, the lawsuit shall be under the jurisdiction of a People’s Court in Chengdu City, Sichuan Province, China. Company shall not be liable for any legal fees and/or other costs incurred prior to receiving complete notification of the claim.
